11.3. VALUE ENGINEERING

Contractual Statement: The Contractor shall not make any alteration and /or modification of the Permanent Works, unless and until the Engineer instructs or approves a Variation refer ▬►FIDIC, Multilateral Development Bank Harmonized Edition March 2006, Clause 13: VARIATIONS AND ADJUSTMENTS, Sub-Clause 13.1: Right to Vary . However the Contractor may, at any time, submit to the Engineer a written proposal which in the Contractor’s opinion (1) accelerates completion,(2)reduces the cost to the Employer of executing, maintaining or operating the Works, (3) improves the efficiency or value to the Employer of the completed Works, or (4) otherwise be of benefit to the Employer. In such cases, the Sub-Clause of Value Engineering gets effective.
